The recent decision of TCV VI, L.P. v. TradingScreen Inc., C.A. No. 10164-VCN (Del. Ch. Sept. 25, 2015) provides a brief yet thorough analysis of the attorney-client privilege and redaction logs.  According to the Court: “Ordinarily, a party asserting privilege must produce both a privilege log and a redaction log absent mutual agreement that a less burdensome arrangement will suffice.” However, as an alternative to a redaction log, the Court allowed senior Delaware counsel to review the redactions at issue and certify that they were consistent with the scope set forth in the opinion.
